Appellant Worlds Inc. appeals the final decisions of the PTAB invalidating three patents (generally relating to the computer-generated display of avatars in a virtual world) in three inter parties reviews (“IPRs”). Because Worlds presented evidence sufficient to put Bungie’s identification of itself as the sole real party in interest into dispute, the Board could no longer merely rely upon Bungie’s initial identification of the real parties in interest. Thus, the CAFC finds that the Board erred in its real-party-in-interest analysis, and vacates the Board’s decisions and remands.
