In a pair of inter partes review proceedings brought by Cisco, the PTAB invalidated all claims of two of TQ Delta’s patents relating to improvements to electronic communications systems that lower the peak-to-average power ratio (PAR) of the transmitted signals in multicarrier communications systems, such as digital subscriber line (DSL) systems. The CAFC holds that the Board’s factfinding regarding motivation to combine is based on conclusory statements and unspecific expert testimony and is therefore unsupported by substantial evidence. Because fact findings underlying the Board’s obviousness determinations are not supported by substantial evidence, the CAFC reverses the Board’s decisions on that ground.
